SMS/MMS and phone communications
Consent is required for marketing messages. We will only send promotional SMS/MMS or automated marketing calls when we have your prior express written consent. For transactional or informational texts (e.g., order status), less formal consent may suffice, but we will still document consent where provided. We log and retain proof of consent, including the method, timestamp, and content of the opt-in, to comply with federal carrier and TCPA rules and Texas law.
Each marketing SMS/MMS will include clear opt-out instructions (for example, “Reply STOP to unsubscribe”). We will honor opt-out requests promptly. If you opt out of SMS, we may still send non-promotional, account or transactional messages unless you also opt out of those via your account settings.
SMS / Text Messaging Terms & Consent
Consent & Program Description
By opting into SMS messages, you give 5th & Home Furniture express written consent to send you recurring promotional text messages (e.g. sale alerts, offers, updates) at the mobile number you provide. Message & data rates may apply. You may receive up to 5 messages per month (or as many as reasonably required).
Reply HELP / STOP
You can reply HELP for assistance or STOP to cancel at any time. After you reply STOP, you will receive a confirmation message, and no further promotional messages will be sent. You may still receive non-promotional, transactional messages (e.g. order status), unless you opt out of those separately (where applicable).
SMS Providers & Third-Party Sharing
We share your phone number and messaging preferences only with trusted third-party SMS service providers (e.g., Klaviyo) to send, manage, and monitor messages on behalf of 5th & Home. We will not sell, rent, or lease your phone number or SMS data to any third party.
Recordkeeping & Proof of Consent
We record and retain proof of consent, including the full consent text presented to you, timestamp, IP address (if available), and any confirmation responses. These records will be retained for the duration required by law and to comply with audits or regulatory inquiries.
How we obtain and document consent
We collect consent in the following ways (and log the consent):
-
Website opt-in checkboxes (unchecked by default) with clear language describing message types and frequency (see sample wording below).
-
Paper or verbal consent when permitted and documented where appropriate for non-marketing informational messages.
-
Text-to-opt-in (user texts a keyword to our number) — we respond with a confirmation text and log the opt-in message, number, timestamp, and IP address when available.
-
Point-of-sale / in-store forms where customers sign or check a box to receive messages (we retain scanned copies or digital records).
We maintain records of the consent method, the full consent language shown to the user, date/time, IP or device identifier (if available), and any confirmation messages sent. These records are retained for at least as long as required by law and to defend against any claim. Keeping detailed records helps with TCPA/FCC, TCR/carrier audits, and Texas requirements.
Texas-specific obligations & telephone-solicitor registration
If we engage in telephone solicitation or text-based marketing to Texas residents, we will comply with Texas requirements, including the need for registration where required by the Texas Telephone Solicitation Act (SB 140). That may include filing Form 3401, paying the applicable fee, and posting any required security/bond as specified by Texas authorities. We will maintain required documentation and honor Texas residents’ telemarketing-related rights.

We do not sell or rent your personal information. We may share data only with trusted third-party providers that help us operate our website or services, and only as necessary.
